1. In contrast to agriculture, mangrove cultivation will be subject to 18% GST: AAAR

The cultivation of mangroves is distinct from agriculture, according to the Appellate Authority for Advance Rulings (AAAR), and as such, it will not be exempt from the Goods and Services Tax (GST). 18% GST will be levied on it.

What took place?

The applicant requested a ruling from the West Bengal AAR that his activities be exempt from GST. The applicant cultivates mangrove seeds into seedlings in nurseries with the goal of protecting the environment from cyclones and tidal waves.

However, in accordance with AAAR, the applicant’s activities will only be considered “support services to agriculture, forestry, fishing, and animal husbandry” if they are connected to the cultivation of plants and the rearing of all life forms of animals, with the exception of horses, for the purpose of producing food, fiber, fuel, raw material, or other products that are comparable.

Therefore, the cultivation of plants for the production of food, fiber, fuel, raw materials, or other similar goods is not the focus of his services.
