Uniform Civil Code: Promoting Equality:

The Uttarakhand administration, led by Chief Minister Pushkar Singh Dhami, has made great progress in advancing equality and guaranteeing equal rights for all of its inhabitants with the implementation of the Uniform Civil Code.

With the goal of establishing social uniformity, all Uttarakhand residents—regardless of their religious beliefs—will be subject to the same set of rules regarding inheritance, land, divorce, and marriage.

Uttarakhand is headed toward becoming the first state to implement UCC since the nation’s independence. The law complies with Article 44 of the Constitution and aims to empower women, advance gender justice, and improve social peace.

Unified Law, Unified Growth:

It is a major step toward achieving the goal of equal rights for all set forth in the constitution. Different personal laws can obstruct social justice and sustain inequality. Uttarakhand wants to create a more just and inclusive society by streamlining its legal system so that all residents are governed by the same set of rules.

Ensuring Equal Rights to Women and Children:

One of UCC’s main advantages is that it promotes gender equality. Without discrimination based on gender, UCC would guarantee women’s equal rights to inheritance and property, irrespective of their religious beliefs.

Additionally, the UCC pledges to protect children’s rights by harmonizing adoption regulations. With the establishment of the UCC, a unified legal framework would ensure that all children, regardless of origin, had an equal right to a family environment.

Promoting Social Harmony:

As diverse religious and ethnic groups coexist, the UCC would uphold the idea that all people are created equal under the law, fostering greater harmony and social cohesion.

Simplifying Legal System:

The existence of several personal laws might lead to contradictory rulings and complicate legal proceedings. The UCC would create a uniform legal framework that would apply to all civil cases, streamlining and improving the effectiveness of the legal system.

Economic Benefits:

A UCC can improve economic activity predictability by guaranteeing the consistency and clarity of property rights. The state’s overall growth may be aided by the investments and economic development that this legal certainty may foster. Women would be able to engage more completely in economic activities.

Exclusion of Scheduled Tribes:

In order to protect Scheduled Tribes’ unique cultural customs and practices, the UCC carefully excludes them from its purview. This thoughtful approach guarantees the preservation of the distinctive identity and legacy.

Legitimacy of children born in live-in relationships:

According to the UCC, children born during a live-in relationship are legitimate. To ensure that they are not treated unfairly or stigmatized, these children are entitled to all the rights of a biological child. This clause fosters children’s acceptability in society by defending their rights and well-being.

Uniform Marriage Age:

The UCC sets a minimum age of 21 for boys and 18 for girls to marry, standardizing the age for marriage across all religions.

What UCC Aims:

1.Give vulnerable, impoverished, and weaker segments of society, security and empowerment

2.Include women, children, youth, and the elderly from all backgrounds in the mainstream of development

3.Encourage a sense of unity, integrity, and nationalism through uniform laws

4.Encourage sons and daughters to pursue higher education by delaying marriage until later in life.

5.Build a flourishing community by putting an end to immoral activities that have persisted for a long time.

6.Remove discrimination between men and women and between sons and daughters by granting equal rights to members of all communities.
